End User License Agreement (EULA) — AHAA Ideas

This End User License Agreement ("Agreement") is a legal agreement between you ("you" or "User") and PT Ahaa Ide Kreatif ("Company," "we," "us," or "our") governing your download, installation, access to, and use of the AHAA Ideas mobile application and any related services, features, content, and functionality made available through the application (collectively, the "App").

By downloading, installing, accessing, creating an account, or using the App, you agree to be bound by this Agreement. If you do not agree to this Agreement, you must not use the App.

1. Scope of This Agreement

This Agreement governs your use of the App. Your use of the App is also subject to our Privacy Policy and any additional policies, community guidelines, or feature-specific terms we may provide from time to time.

To the extent there is any conflict between this Agreement and any other terms relating specifically to the license of the App, this Agreement will control.

2. License Grant

Subject to your compliance with this Agreement, PT Ahaa Ide Kreatif grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App on devices that you own or control, solely for your personal, lawful use and only in accordance with this Agreement.

This license does not transfer any ownership rights in the App to you.

3. License Restrictions

You may not, and you may not permit or assist any third party to:

• Copy, reproduce, modify, adapt, translate, or create derivative works of the App;
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, underlying ideas, algorithms, structure, or organization of the App, except where expressly permitted by applicable law;
• Rent, lease, lend, sell, redistribute, sublicense, assign, publish, or otherwise transfer the App or make the App available to any third party;
• Remove, alter, obscure, or destroy any copyright, trademark, or proprietary notices contained in or on the App;
• Use the App in any manner that violates applicable laws, regulations, or third-party rights;
• Use the App to distribute malware, malicious code, spam, fraudulent content, or harmful links;
• Interfere with or disrupt the operation, security, or integrity of the App or any related systems, servers, or networks;
• Attempt to gain unauthorized access to any portion of the App, user accounts, or connected systems;
• Use automated means, scraping tools, bots, or similar technologies to access or interact with the App in an unauthorized manner.

4. Eligibility and Age Requirement

You must be at least 13 years old to use the App. By using the App, you represent and warrant that:

• You are at least 13 years of age; and
• You have the legal capacity to enter into this Agreement.

If you are under the age of majority in your jurisdiction, you may use the App only with the permission and supervision of a parent or legal guardian.

5. User Accounts and Account Security

To access certain features, you may be required to create an account or sign in using a supported third-party provider, including Sign in with Google and Sign in with Apple.

You agree to:

• Provide accurate, current, and complete information;
• Keep your account credentials secure and confidential;
• Notify us immediately of any unauthorized use of your account or any security breach; and
• Be responsible for all activities that occur under your account.

We reserve the right to suspend, restrict, or terminate your account if we believe you have violated this Agreement, applicable law, or the safety and integrity of the App or its users.

6. User Content

The App may allow you to create, upload, submit, share, post, publish, transmit, or otherwise make available content, including but not limited to posts, photos, videos, audio, files, links, and profile information (collectively, "User Content").

6.1 Ownership of User Content

You retain ownership of your User Content. We do not claim ownership over content you create or upload.

6.2 License You Grant to Us

By submitting or making User Content available through the App, you grant PT Ahaa Ide Kreatif a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, process, adapt, modify (for formatting, display, technical compatibility, moderation, localization, or operational purposes), publish, transmit, distribute, publicly display, and otherwise use your User Content solely for the purposes of:

• Operating and providing the App;
• Enabling social and interactive features of the App;
• Improving, maintaining, securing, and supporting the App;
• Reviewing, moderating, investigating, or enforcing compliance with this Agreement; and
• Complying with legal obligations.

6.3 Your Responsibilities

You are solely responsible for your User Content and represent and warrant that:

• You own or have all necessary rights, licenses, consents, and permissions to upload and use your User Content;
• Your User Content does not infringe or violate any intellectual property, privacy, publicity, confidentiality, contractual, or other rights of any person or entity;
• Your User Content does not violate any law, regulation, or this Agreement.

7. No Tolerance for Objectionable Content and Abusive Users

AHAA Ideas has zero tolerance for objectionable content or abusive users.

You may not create, upload, post, share, transmit, or otherwise make available any content, or engage in any behavior, that is unlawful, harmful, threatening, abusive, harassing, defamatory, hateful, discriminatory, sexually exploitative, fraudulent, misleading, invasive of privacy, infringing of intellectual property rights, or otherwise objectionable.

We reserve the right, at any time and in our sole discretion, to monitor, review, restrict, remove, disable access to, or refuse to publish any content, and to suspend, restrict, or terminate any account, without prior notice, if we believe that content or behavior:

• Violates this Agreement;
• Harms or threatens other users;
• Threatens the safety, integrity, or proper functioning of the App; or
• May expose us, our users, or third parties to legal, security, or reputational risk.

By using the App, you acknowledge and agree that we may enforce these rules to help maintain a safe and respectful environment for all users.

8. Prohibited Content and Conduct

Without limiting Section 7, you may not use the App to create, upload, share, or distribute any content, or engage in any conduct, that:

• Is unlawful, fraudulent, misleading, or deceptive;
• Contains hate speech, discrimination, or content that promotes violence or harm against individuals or groups;
• Harasses, threatens, bullies, abuses, or intimidates others;
• Involves sexual exploitation, child sexual abuse material, or any exploitative or abusive sexual content;
• Impersonates another person, organization, or entity, or misrepresents affiliation;
• Infringes copyrights, trademarks, trade secrets, or other intellectual property rights;
• Contains spam, scams, phishing attempts, deceptive promotions, or unauthorized advertising;
• Includes viruses, malware, malicious code, or harmful links;
• Violates privacy rights, including unauthorized disclosure of personal, confidential, or sensitive information;
• Encourages illegal activities, self-harm, violence, or dangerous conduct;
• Otherwise threatens the safety, integrity, or proper functioning of the App or its community.

We may remove content, restrict visibility, suspend accounts, or terminate access for violations of this Section.

9. Reporting, Blocking, Moderation, and Enforcement

We provide mechanisms for users to report posts and report users. Where available in the App, users may also block other users.

You acknowledge and agree that we may, in our sole discretion:

• Review reported or suspected content or conduct;
• Remove, restrict, disable access to, or refuse to publish any User Content;
• Warn, suspend, restrict, or terminate user accounts;
• Limit access to specific features;
• Preserve and disclose information where required to comply with law, enforce this Agreement, protect user safety, or protect our rights.

Our moderation and enforcement may be carried out using a combination of user reports, manual review, technical detection systems, and internal policy enforcement processes.

10. Social, Messaging, and Community Features

The App may include social features, including posting, user interactions, messaging, profile visibility, content discovery, and other community functions.

When using these features, you agree to engage respectfully and lawfully. We are not responsible for user interactions, communications, or conduct by other users. You understand that content and communications from other users may be inaccurate, offensive, or inappropriate, and you use social features at your own risk.

11. AI-Assisted Features

The App may include artificial intelligence or machine-assisted tools to help users generate, draft, edit, improve, or suggest content.

By using AI-assisted features, you acknowledge and agree that:

• AI-generated outputs may be inaccurate, incomplete, biased, offensive, or unsuitable for your intended use;
• AI-generated content is provided for convenience only and does not constitute professional, legal, medical, financial, or other regulated advice;
• You are solely responsible for reviewing, editing, and evaluating any AI-generated output before posting, sharing, relying on, or otherwise using it;
• We may use prompts, inputs, and related usage data as necessary to provide, operate, maintain, improve, moderate, and secure AI-related functionality, subject to our Privacy Policy.

We do not guarantee the originality, legality, or suitability of AI-generated outputs.

12. Location-Based Features

The App may include location-based functionality. By enabling or using such features, you consent to the collection, use, and processing of location-related information as described in our Privacy Policy and device settings.

You acknowledge that:

• Location data may not always be accurate, complete, or current;
• Features depending on location may vary based on device capabilities, permissions, network conditions, and geographic availability;
• You are responsible for managing your location permissions through your device settings.

We are not liable for issues, inaccuracies, or consequences arising from inaccurate or unavailable location data.

13. Third-Party Services and Sign-In Providers

The App may integrate with third-party services, platforms, or tools, including but not limited to Apple, Google, analytics providers, hosting infrastructure, and other technical service providers.

Your use of third-party services may be subject to those third parties' own terms, privacy policies, and rules. We do not control and are not responsible for the availability, accuracy, content, security, or practices of third-party services.

14. Intellectual Property

The App, including all software, code, design, interfaces, graphics, features, trademarks, service marks, logos, branding, and all content provided by PT Ahaa Ide Kreatif (excluding User Content), is owned by or licensed to PT Ahaa Ide Kreatif and is protected by applicable intellectual property and other laws.

Except for the limited license expressly granted in this Agreement, no rights, title, or interest in or to the App are granted to you.

15. Updates and Changes to the App

We may from time to time provide updates, bug fixes, patches, upgrades, or new versions of the App. This Agreement applies to all such updates unless a separate license is provided.

We may also modify, suspend, discontinue, or remove any feature, content, or functionality of the App at any time, with or without notice, to the extent permitted by law.

16. Termination

This Agreement remains in effect until terminated by you or by us.

We may suspend or terminate this Agreement and your access to the App immediately, with or without notice, if:

• You violate this Agreement;
• We believe your conduct creates risk, harm, or potential legal exposure;
• We are required to do so by law or platform requirements; or
• We discontinue the App or relevant services.

Upon termination:

• The license granted to you under this Agreement immediately ends;
• You must stop using the App and delete all copies from your devices;
• Any provisions that by their nature should survive termination will remain in effect, including provisions relating to intellectual property, disclaimers, limitation of liability, indemnity, dispute resolution, and rights concerning User Content already processed or shared.

17. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

PT AHAA IDE KREATIF DISCLAIMS ALL WARRANTIES, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT:

• THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE;
• THE APP WILL ALWAYS BE AVAILABLE OR FUNCTION WITHOUT DELAYS;
• ANY CONTENT, INCLUDING USER CONTENT OR AI-GENERATED OUTPUTS, WILL BE ACCURATE, COMPLETE, RELIABLE, OR SUITABLE;
• ANY DEFECTS WILL BE CORRECTED.

18. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PT AHAA IDE KREATIF, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, LICENSORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, REVENUE, GOODWILL, BUSINESS OPPORTUNITY, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO:

• YOUR ACCESS TO, USE OF, OR INABILITY TO USE THE APP;
• USER CONTENT OR CONDUCT OF ANY USER OR THIRD PARTY;
• UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR DATA OR CONTENT;
• ANY INTERRUPTION, BUG, ERROR, VIRUS, OR TECHNICAL FAILURE;
• YOUR RELIANCE ON CONTENT, INCLUDING AI-ASSISTED OUTPUTS OR LOCATION-BASED FEATURES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THIS AGREEMENT OR THE APP SHALL NOT EXCEED THE GREATER OF:

• THE AMOUNT YOU PAID US, IF ANY, FOR USE OF THE APP IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR
• USD $10.00, IF YOU PAID NOTHING.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS OR LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

19. Indemnification

You agree to defend, indemnify, and hold harmless PT Ahaa Ide Kreatif, its affiliates, directors, officers, employees, licensors, and agents from and against any claims, damages, liabilities, losses, costs, and expenses (including reasonable legal fees and expenses) arising out of or related to:

• Your use or misuse of the App;
• Your User Content;
• Your violation of this Agreement;
• Your violation of any applicable law, regulation, or third-party rights.

20. Governing Law and Dispute Resolution

This Agreement is governed by and construed in accordance with the laws of the Republic of Indonesia, without regard to conflict of law principles.

Any dispute, claim, or controversy arising out of or relating to this Agreement or your use of the App shall be subject to the exclusive jurisdiction of the courts located in Jakarta, Indonesia, unless mandatory applicable law requires otherwise.

21. App Store-Specific Minimum Terms

If you access or download the App through a third-party app distribution platform, including Apple's App Store, the following additional terms apply to the extent required by that platform:

• This Agreement is concluded between you and PT Ahaa Ide Kreatif, and not with the platform provider.
• PT Ahaa Ide Kreatif, and not the platform provider, is solely responsible for the App and any maintenance or support for the App.
• PT Ahaa Ide Kreatif, and not the platform provider, is responsible for addressing any claims relating to the App, including product claims, legal or regulatory compliance claims, and consumer protection claims, to the extent required by applicable law.
• In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, PT Ahaa Ide Kreatif will be solely responsible for the investigation, defense, settlement, and discharge of such claim.
• To the extent a platform provider is required to be treated as a third-party beneficiary of this Agreement under its platform rules, such provider shall have the right to enforce the relevant provisions of this Agreement against you.

23. Entire Agreement

This Agreement constitutes the entire agreement between you and PT Ahaa Ide Kreatif regarding the App and supersedes all prior or contemporaneous understandings, agreements, communications, and proposals relating to the App.

If any provision of this Agreement is held to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.

24. Changes to This Agreement

We may update or revise this Agreement from time to time. If we make material changes, we may provide notice through the App, by posting an updated version, or by other reasonable means.

Your continued use of the App after the updated Agreement becomes effective constitutes your acceptance of the revised Agreement.
